These Terms of Service (the "Terms") govern your use of the Kube9 platform and services provided by Alto9 ("we," "us," or "our"). Kube9 includes our VS Code extension, desktop application, web portal, operator, and related services (collectively, the "Services").
All intellectual property rights in the Services, including but not limited to software, documentation, trademarks, logos, and content, are owned by Alto9 or our licensors. Certain components of Kube9 are provided under open source licenses (including the MIT License), which are separate from these Terms and govern your rights to use, modify, and distribute those specific components.
By accessing or using any part of the Kube9 Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services. These Terms apply to all users of the Services, including users of our free tier, paid subscriptions, and open source components.
You represent and warrant that you have the legal capacity and authority to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and the terms "you" and "your" will refer to both you and the organization.
Kube9 provides visual Kubernetes cluster management tools and services. Our Services include:
Kube9 VS Code Extension: A free Visual Studio Code extension that provides visual Kubernetes cluster management directly in your IDE, including tree view navigation, resource editing, and multi-cluster support.
Kube9 Desktop: A native desktop application offering AI-powered cluster management with advanced features, available through free and paid subscription tiers.
Kube9 Portal: Our web portal for account management, user authentication, API key generation, and subscription management.
Kube9 Operator: An optional Kubernetes operator that can be installed in your clusters to provide enhanced monitoring, metrics, and cluster intelligence.
Kube9 offers both free and paid subscription tiers. The Kube9 VS Code Extension is available free of charge. Kube9 Desktop and certain advanced features may require a paid subscription. We reserve the right to modify, suspend, or discontinue any free tier features at any time. Paid subscription terms, pricing, and features are described on our pricing page and may be updated from time to time.
Certain components of Kube9 are provided as open source software under the MIT License or other open source licenses. Your use of open source components is governed by their respective licenses, which are separate from these Terms.
Some features of Kube9 require you to create an account. When you register for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
To access certain features of Kube9, you may need to create an account through our portal. During registration, you will be asked to provide information such as your email address and create a password. You agree to provide accurate and complete information and to update such information to keep it accurate and complete.
You may not create an account for anyone other than yourself, and you may not share your account credentials with others. We reserve the right to refuse service, terminate accounts, or remove or edit content in our sole discretion.
You are responsible for maintaining the security of your account and password. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to comply with this security obligation.
Pricing for paid subscriptions is displayed on our pricing page and may be updated from time to time. All prices are in U.S. dollars unless otherwise stated. You agree to pay all fees associated with your subscription.
You are responsible for any applicable taxes, duties, or government charges that may be imposed on your use of paid Services. We may collect applicable sales tax or value-added tax where required by law. If you are exempt from paying taxes, you must provide us with a valid tax exemption certificate.
For paid subscriptions, payment is due in advance on a monthly or annual basis, as selected during purchase. We accept payment via credit card, debit card, or other payment methods we make available. By providing payment information, you authorize us to charge your payment method for all fees due.
If your payment method fails or your account is past due, we may suspend or terminate your access to paid Services. You remain responsible for any uncollected amounts.
Subscription fees are generally non-refundable. However, we may provide refunds or credits at our sole discretion in certain circumstances, such as if we are unable to provide the Services due to technical issues on our end, or if required by applicable law. Refund requests must be submitted within 30 days of the charge date.
If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods.
Cluster Access and Permissions: Kube9 requires access to your Kubernetes clusters to provide its functionality. By using Kube9, you acknowledge and agree that:
Kube9 may have read and write access to your Kubernetes clusters based on the permissions granted in your kubeconfig file and cluster role bindings.
You are solely responsible for ensuring that Kube9 has appropriate permissions for your intended use and that you have the legal right to grant such access.
You are responsible for maintaining the security of your kubeconfig files, API keys, and other credentials used to access your clusters.
We are not responsible for any unauthorized access to your clusters, data loss, or security breaches that occur as a result of your use of Kube9 or your cluster configuration.
You should use Kube9 only with clusters and resources that you own or have explicit permission to manage.
Data Security: While we implement security measures to protect your account information and telemetry data, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.
Cluster Data: Kube9 processes cluster data locally on your machine (for VS Code extension and Desktop) or within your cluster (for the Operator). We do not transmit your cluster data, secrets, or credentials to our servers for analysis. However, we do collect telemetry and usage data as described in our Privacy Policy.
Kube9 collects telemetry data and user information to improve our Services, diagnose issues, and understand usage patterns. This includes but is not limited to:
Usage statistics (features used, frequency of use, error rates)
Device and system information (operating system, application version)
Performance metrics and crash reports
Account information and subscription status
We do not collect your Kubernetes cluster data, secrets, credentials, or resource configurations for analysis. All cluster data analysis occurs locally on your machine or within your cluster. For more information about what data we collect and how we use it, please see our Privacy Policy.
Portions of Kube9 are provided as open source software under the MIT License or other open source licenses. Your use of open source components is governed by their respective licenses, which are separate from these Terms. The open source licenses grant you additional rights to use, modify, and distribute those specific components.
For open source components, the applicable open source license terms take precedence over these Terms to the extent they conflict. You can find the source code and license information for open source components in our repositories.
Service Availability: We strive to provide reliable Services but do not guarantee that the Services will be available at all times or free from errors, interruptions, or defects. We may modify, suspend, or discontinue any part of the Services at any time.
No Warranty: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTO9 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
Our total liability for any claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "effective as of" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.
If you do not agree to the modified Terms, you must stop using the Services. If you have a paid subscription, you may cancel your subscription in accordance with Section 6.1.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Services shall be resolved in the state and federal courts located in Florida.
If you are located outside the United States, you agree that any disputes will be resolved in accordance with Florida law, and you consent to the jurisdiction of Florida courts.
